Criminal convictions in cases reported by Justice Alexandre de Moraes of the Supreme Federal Court (STF) could worsen his situation
247 – Former President Jair Bolsonaro faces the possibility of being prevented from running in the 2030 elections due to criminal cases and the Federal Court of Accounts (TCU). The TCU may extend his ineligibility beyond 2030, and even to the 2032 elections. Additionally, criminal convictions in cases reported by Justice Alexandre de Moraes of the STF could worsen his situation. The Superior Electoral Court (TSE) has determined that Bolsonaro abused his political power and misused media channels during a meeting with ambassadors in which he discredited electronic voting machines. This process will be forwarded to the TCU, and the information will be used in criminal investigations at the STF, as reported by journalists Matheus Teixeira and José Marques in Folha de S. Paulo.
The TCU's decision on Bolsonaro's ineligibility depends on receiving the TSE's decision and initiating an internal process to evaluate the case. Meanwhile, the Deputy Prosecutor General of the Public Prosecutor's Office at the TCU has already requested an investigation into possible damages to public funds resulting from the abuse of political power. Behind the scenes, it is considered unlikely that the court will not condemn Bolsonaro, given that the TSE has already ruled on the illegality of his actions. It is expected that the TCU will order the return of public funds used in the event in question.
In addition to the possibility of ineligibility determined by the TCU, Bolsonaro may also face criminal convictions in the coming months. Justice Alexandre de Moraes mentioned digital militias in his vote at the TSE and indicated that he would point to Bolsonaro as one of the masterminds behind the attacks. The accusations include the dissemination of fake news and misinformation throughout his term. If convicted, Bolsonaro could be deemed ineligible based on the Clean Slate Law or have his political rights suspended during the sentence, as provided for in the Constitution.
